Stuart pleads not guilty to sexual abuse charge

Stoney Avery Stuart — who allegedly sexually abused a 17-year-old female in July — has entered a plea of not guilty for the third-degree sexual abuse charge against him.

According to a Creston Police report, evidence collected does indicate the 20-year-old Stuart of Creston engaged in a sex act with the female who was incapacitated, disabled or deprived the ability to control conduct because of the influence of an intoxicating substance, and/or unable to communicate unwillingness to act because of being unconscious, asleep or otherwise physically limited.

A pretrial conference in Stuart’s case is scheduled 9:30 a.m. Nov. 15 at the Union County Courthouse. A trial is slated for 9:30 a.m. Jan. 27, 2014.

Meanwhile, Evin Lawrence Scadden — who allegedly sexually abused a female on the same day Stuart allegedly did — has not entered a plea yet. Scadden’s arraignment is slated 9 a.m. Sept. 20.
