Alex Cunningham, 23, 1024 W. Crest Dr., was charged with operating while intoxicated, interference with official acts and assault on a peace officer 4:17 p.m. Friday at the intersection of North Spruce and West Prairie streets.
According to a Creston Police report, officers responded to a call regarding a vehicle taken from the parking lot of Casey’s, 903 N. Sumner Ave. A vehicle matching the description of the taken vehicle was leaving the parking lot. Officers performed a traffic stop on the vehicle at North Spruce and West Prairie, where the vehicle went up over the curb of North Spruce before coming to a stop. Officers made contact with the driver, Cunningham. He seemed confused and had droopy eyelids. After officers spoke with Cunningham, it seemed he was under the influence. He consented to standard field sobriety test instruction and officers observed several indications of impairment. Cunningham refused a preliminary breath test. Cunningham resisted arrest by officers and pulled his arms away and clenched his fists together in front of him. Officers had to force Cunningham’s hands behind his back to charge him. Officers transported Cunningham to Union County Law Enforcement Center. They sat him down in the office, and as an officer placed a handcuff on Cunningham’s wrist he spit on the officer’s face as the officer walked away.
Cunningham was released on $1,000 bond.
